BILLING TERMS & CONDITIONS

Rates & Session Terms

All rates are based on an eight (8) hour day, unless otherwise negotiated in writing. The 8-hour day includes up to one (1) hour paid lunch, with meals provided by Client after four (4) hours.

Overtime is billed at 1.5x the applicable hourly rate plus a 20% agency fee, billed in actual time incurred after eight (8) hours.
Any overnight or after-hours shoots must be disclosed prior to talent confirmation and may be billed at 1.5x hourly plus a 20% agency fee.

Lingerie/Swimwear bookings are billed at 1.5x the original session rate plus a 20% agency fee, in 30-minute increments, and require prior agency and model approval. Client must provide a private dressing area when necessary.

Cancellations & Weather Permits

For confirmed bookings:

• Within 48 business hours: 100% of fee
• Within 72 business hours: 50% of fee
• Within 96 business hours: 25% of fee

For weather-permit shoots, same-day cancellations are billed at 50% if immediately rescheduled or 100% if not rescheduled. Earlier cancellations follow standard policy. Book or Release options will be enforced once secondary bookings are ready to confirm.

Usage Rights & Artificial Intelligence (AI)

All usage rights are limited to those specifically granted in writing and may not be extended without renegotiation. All releases must be pre-approved by Agency and Talent prior to on-set arrival.

AI Restriction:
No images, likenesses, names, voices, performances, biometric data, or other materials created or captured in connection with a booking may be used with, uploaded to, trained on, reproduced by, or otherwise exploited through Artificial Intelligence or similar technologies without the prior written consent of 10 MGMT and Talent. Any permitted AI use requires a separate written agreement and additional compensation. Unauthorized AI use constitutes a material breach.

Agency Fees & Payment Processing

A 20% agency service charge applies to all billings.

• Credit Card Payments: additional 4% processing fee
• PayPal Payments: additional 4% processing fee

Unless a valid workers’ compensation certificate is provided, invoices may include an additional 2% workers’ compensation fee. For new clients, full payment in advance may be required to secure bookings.

Payment Obligations, Late Fees & Collections

Payment obligations are absolute and non-contingent and not dependent on third-party payment.

For past-due invoices:

• $350 flat fee for invoices under $20,000
• $600 flat fee for invoices $20,000 and over
• 2% monthly interest until paid in full

Client agrees to be responsible for all court costs, collection costs, and attorneys’ fees incurred in recovering unpaid amounts.

Statutory Compliance

This Agreement complies with the Illinois Freelance Worker Protection Act (FWPA). Where applicable, payment shall be made by the stated due date or, if none, within 30 days of service completion.

For California bookings, Client acknowledges obligations under California Labor Code §§201.6 and 204 regarding timely payment of model wages.

Governing Law & Confidentiality

This Agreement is governed by the laws of the State of Illinois, with venue in Cook County, Illinois. This document may contain confidential and privileged information and may not be distributed without authorization.
